Article 1 – Parties

1.2. Buyer
The person whose name, Turkish ID number, address, phone and email are provided when placing the order.
Article 2 – Subject
This agreement sets out the rights and obligations of the parties, under Consumer Protection Law No. 6502 and the Distance Contracts Regulation, regarding the sale and delivery of the product/service ordered electronically by the BUYER from the SELLER's website https://biadak.com, as specified below.
The BUYER confirms that they have been informed clearly and appropriately about the SELLER's details, the essential characteristics of the product, the sale price including taxes, payment method, delivery terms and costs, the right of withdrawal and how to exercise it, and the official bodies to which complaints may be made; that they have confirmed this preliminary information electronically; and that they then placed the order.
The preliminary information on https://biadak.com and the invoice issued for the BUYER's order form an integral part of this agreement.
Article 3 – Product, payment and delivery
The type, quantity and price of the product/service, the payment method, recipient, delivery address and billing details are determined when the order is placed. The invoiced person and the contracting person must be the same. The BUYER is responsible for providing accurate and complete information and accepts liability for any damage arising from incorrect or incomplete information.
The SELLER reserves the right to suspend an order if the information provided does not match reality. If a problem is detected and the BUYER cannot be reached via the phone, email or postal address provided, the order is put on hold for 15 (fifteen) days. If no response is received within this period, the SELLER cancels the order to avoid harm to either party.
3.1. Persons under 18 may not order via biadak.com. The SELLER relies on the age declared by the BUYER and cannot be held liable for a false declaration.
3.2. The SELLER is not responsible for price errors caused by system faults, or for errors resulting from unlawful interference with the website. The BUYER cannot make claims against the SELLER based on system errors.
3.3. Payment can be made by credit card (Visa, MasterCard, etc.) or bank transfer/EFT. Orders not paid within one week of the order date are cancelled. An order is processed once the card payment is collected or the transfer reaches the SELLER's account. For transfers, the sender details must match the billing details and the order number must be written in the description. Cash-on-delivery or postal cheques not agreed with customer service are not accepted.
3.4. If it becomes clear for a justified reason that the product cannot be supplied, the BUYER is informed immediately; with the BUYER's consent, a product of equal quality and price may be supplied, the removal of the obstacle may be awaited, or the order may be cancelled. If delivery becomes impossible, the BUYER is informed and the total amount paid, together with any documents creating a debt, is refunded within 14 (fourteen) days at the latest and the agreement is terminated.
3.5. If paying by credit card, the BUYER agrees to confirm interest and default interest rates with their bank, and that these are governed by the credit card agreement between the bank and the BUYER.
Article 4 – Dispute resolution
Disputes arising from this agreement are handled by the Consumer Arbitration Committees at the BUYER's or SELLER's place of residence within the monetary limits announced annually by the Ministry of Trade, and by the Consumer Courts above those limits.
By confirming the order, the BUYER is deemed to have accepted all terms of this agreement.
